who here studies law ?
« on: July 22, 2006, 10:59:44 AM »
what would happen, if a drunk guy was being rowdy and offensive, and starting fights with people... then when a sober person tries to calm him down, he takes a swing, so the sober person swings back, and knocks the drunk out, he hits his head and dies...

is it self defense or man slaughter ?

well, i dont study law per se but i've had a lot of courtroom experience and my daddy was a chp for some time. in America it all depends how good your scumbag lawyer is. a case like that seems pretty cut and dry though its self defense, plus sober pretty much always >>>>drunk in court, i hope youre not going thru this rite now are you?

this is involuntary manslaughter...
it's involuntary..because the person who hit the sober man didn't mean to kill him....and manslaughter because you kill him by him hitting his head. very different with murder.

self defense is always really hard to prove,  especially in a case of sober v. drunk

what would happen, if a drunk guy was being rowdy and offensive, and starting fights with people... then when a sober person tries to calm him down, he takes a swing, so the sober person swings back, and knocks the drunk out, he hits his head and dies...

so would someone get any time for involuntary manslaughter ?

yes as matter of fact...could up to any years if determined sentences (normally up to 10 years) undetermined sentence is given...(range can be anywhere 5 to 10 years.)

^ what if it was in self defence ? and there were more than 5 witnesses ? and the reaction to the swing was in an instant ? and the person that defended themself stayed with the drunk until the ambulance arrived ? and didnt flee the scene ? and admitted to hitting the cunt ? what then ?

if this happened in the netherlands you need to be in jail from monday till friday for like 8 months and you can stay at home every saturday and sunday.

in youre jail you will have a TV, PC and a PS2
