~[SCCITvsPhiasko]~ ROCKY THEME COPY OR NOT???~

Okay, now I made this beat the other day and sccit is complaining that it sounds exaclty like the ROCKY BALBOA THEME (which I've never heard or even seen the movie)... I think that it has the same rhythm, but definatly not the same notes and doesn't sound the same. If anyone knows anything about music and law, they would know that this could not hold up a case in court. What do you guys think. Sccit gives his opinion in this little audio portion...

Honestly...how can u say that these 2 dont sound alike? The tune is exactly the same...If you tell me this couldn't make a case in court than i feel bad for your ears...


Not only that, I think the actual Rocky Balboa Theme (Not the one I-Bo remade) sound's even more alike Phiaskos beat...PeAcE

And it wouldn't make a case in court because theyre not the same notes... it's only the same rhythm... if you don't know what the difference is, then sorry. But I had not even heard this song before I made it, so i was not trying to mimic the rhythm nor the sound. Alot of songs have the same rhythm, theres only so many, wut should all they go to court???

they sound alike but i don't think it's a copy...i believe phiasko...it doesn't do all the other shit like the rocky theme...just those couple notes...whatever though, peace.

Well...  here's my two cents....

they both have the same rhythm... but at different tempos and different instruments... they sound different to the ear, but they do have the same tune... however I think it wouldn't work in court... cause they are two different pieces and are different enough

im not saying that i think that he copied.... i dont even know if he heard my beat before (he says no, but NIK says yes)...
but im my beat was copyrighted, he would faceproblems if he released that beat... sampling is not only note by note, its also about structure... well i care less.. its just a beat

Okay... first of all.... the rhythms aren't exact, I went and listened to them closley, and they're off by one count, I can recreate I-Bo's and show you the difference if you want to make it a hastle for me. Second of all, they're not the same tempo, and their not the same instruments, and they're definatly not the same notes. And it definatly would not make a case in court...I'll get a proffesional opinion on it and then post it... you guys dont know what your talking about tho. no worries tho, I'm not trippin'.

Let me break it down for you:

My rhythm: I--- ---- --I- -I--
I-Bo's rhythm: I--- ---- ---- II--

My tempo: 83 BPM
I-Bo's tempo: 97 BPM

And then as far as the notes, they're waaay different. Not only are they not the same notes, they're not the same pitch or octave.

Therefore, you have no case!
