That article is complete bullshit. All the Supreme Court said was that generic drug manufacturers can't be sued in state court for a drug's design defects if federal officials approved the brand-name version the generic drug copied. The ruling only applied to generic drug companies being sued in state courts if the federal government approved the drug. It's just a federalism issue.

teddy what you pointed out is duly noted but i wanna make a point here - i get what infinite is trying to say.  there are too many lawsuits coming from retards like gloria allred and folks like her, but drug companies are a whole different animal.  we havent even scratched the surface as to what all this adderrall and bullshit theyre force feeding any kid who cant pay attention for an hr straight in school is doing to our society.  but then again, its a free choice made by the parents to give them this shit.  if they were awake, they probably wouldnt.  but theyve allowed themselves to be basically brainwashed.

keep in mind i dont agree with new regulation or laws on much of anything.  generally speaking.  if we enforced the laws we had correctly we wouldnt be in the clusterfuck we find ourselves in half the time.

Are you serious?

I agree that businesses should have less regulation, but they shouldn't be exempt when breaking common law (loss, harm or injury). Nobody should be above the law.

Regulation is different to recourse and remedy in the courts. If you or I were harmed say by some vaccine that has a safety issue, ie mmr,  tamiflu or medicine infected with the aids virus I'd sure want to prosecute against them.
Immunity, whether it's corporate or diplomatic is one reason for the corrupt state and mess the world is in!

What about personal responsibility?

A drug company doing harm to someone is different from me beating someone's ass.  And the difference is a very important difference and it makes all the difference in the world.  The difference is the use of force.  America is a country that was founded on individual liberty.  If I beat someone's ass then I have infringed upon their individual liberty.  But a drug company selling a drug on a market is not infringing upon anyone's liberty.  Each individual has a right to buy the drug or not buy the drug according to their own free will.  This should be no business of the government. 

We can take it a step further and say that if the government got out of the drug business and the FDA were closed down (as Ron Paul advocated) then it would open up the market for the consumer advocate industry and they could better aid us in guiding us as to which medicines or vaccines we should purchase.

Yes it's buyer beware also, but unless you are a chemist and have the equipment and scientific knowledge how will people check if the drug is safe?

If you have a car accident under common law you still can sue for damages regardless if it was no intent of having an accident, if that makes sense.
What stops the the drug companies putting whatever poison in their drugs without any recourse? It's happened in the past and is currently happening, especially as the elite what to reduce population. I won't even bother going into gmo foods and Monsanto!

Common law is the basis for libertarian philosophy - it pretty much covers everything and there's little need for statutes.

That's not a free market philosophy at all.  The free market says that a drug company will take responsibility for the quality and safety of their product or else they might possibly lose business to competitors who offer a similar product that has proven to be safe and effective.

That is also true, but it's also the fear of getting legal action against them if there product is proven to be the cause of injury for e.g..
The onus is on the the individual drug companies to up their game in term of quality and safety, but what we have is limited liability because of external regulators and statute, and on the face of what the op is saying (if  not had time to check the link), they will have even less or no liability.
They are in a position of trust.

Just as the free market has helped increase the safety of cars ie anti locking brakes, air bags, crumple zones and other equipment as extra selling points back in the day are now standard in nearly all cars. (Sorry gone a bit off topic).
