Teen Gets Four Life Terms For Rapes When He Was 14 SANTA ANA -- The youngest person in Orange County history charged as an adult in a rape case was sentenced today to 64 years to life in prison.

18-year old Jose Avina was only 14 years old when he used a knife to prey on three 12-year-old boys and a 13-year-old, Senior Deputy District Attorney Kal Kaliban said.

Avina was convicted Aug. 13 of 11 sex and robbery charges for attacking the four boys, who attended junior high school.

He was convicted of two counts each of sodomy by force, kidnapping to commit robbery, second-degree robbery and dissuading a witness by force or threat, and one count each of forcible oral copulation, kidnapping to commit a sexual offense and attempted second-degree robbery.

The jury also found true the enhancement of personal use of a deadly weapon.

Avina will have to serve 85 percent of the 64 years -- nearly 54 1/2 years -- before becoming eligible for parole, Kaliban said.

The first attack occurred on Oct. 4, 2004, when Avina approached a 12- year-old boy walking home from school. The defendant forced the boy to go to his house and held up a knife and threatened the victim before sodomizing him, Kaliban said.

On Oct. 27, 2004, Avina targeted a 13-year-old boy walking to school. After pulling out a knife, ordering the victim into a back alley and threatening to rob him, that boy escaped, the prosecutor said.

On Nov. 15, 2004, Avina attacked two other 12-year-olds. He robbed and sodomized one of the boys and waved a knife at the other youth, who was able to run away, Kaliban said.

All four boys testified, but Avina did not, and no explanation or motive was ever given, Kaliban said.
