By France banning the headscarf, more moderate muslims feel like they are being victimised. In any culture or religion, you will fight against victimisation.  I hear what you're saying, but it's a catch 22 situation, because either way the terrorists are going to say they won.  Obviously most muslims are peaceful, but if they build the mosque at ground zero, Al Qaeda are going to claim that as a victory.  Regardless of whether or not it's the truth, it will be perceived by some that Al Qaeda managed to knock down a symbol of the west and build a symbol of Islam in it's place. I don't think everyone will see it that way, but to some outsiders it will be perceived as  weakness on the part of the U.S.
 Having said that, the people who want to put the mosque there aren't really doing anything illegal, so there's really no way to lawfully stop them.

I know what you saying, but in my opinion, a citizens right to religious freedom is greater than the possibility of Al Aqaeda saying they won. Your civil rights should come before anything. Once you lose that right, you lose democracy. Trust me, im from South Africa...as you know we got some history with discrimination. We learnt our lessons the hard way. Back then the ANC were listed by the South African government as terrorists. Many of the laws they passed used the excuses of terrorism, almost exactly what the USA is going through now...

Marginalising any minority would definately not work...
