The people held at Guantanomo Bay weren't soldiers fighting for their country (in this case Afghanistan). They are Al-Queda terrorists.

agreed, but shadyguru called them prisioners of war who are protected by the geneva convention, merceneries, geurilla groups who don't identify themselves and groups who target civillians are not protected by the geneva convention which is why america justifies torture there. but the bigger issue is they are being held without charge and setting a bad example to the rest of the world.
