Toxicology results for Keith Bender Jr. -- the man police say was shot and killed by Detroit rapper Proof -- likely won't be ready for another three weeks, authorities said Tuesday.
That's because Bender's alleged shooter already has died, meaning there's no rush to find answers for criminal proceedings, said Albert Samuels of the Wayne County Medical Examiner's Office.
Proof, whose born name was Deshaun Holton, had a 0.32 percent blood-alcohol content when he died, Samuels said. That's more than three times higher than the level at which a person can be convicted of drunken driving.
He had no other drugs in his system.
Police said Proof shot Bender once in the face during an argument over a pool game in the early morning hours April 11 at an illegal after-hours club on 8 Mile in Detroit.
Bender's cousin, Mario Etheridge, then allegedly shot Proof three times in the head and chest. Etheridge faces gun charges in the incident.
Lawyers for Bender's family filed a wrongful death lawsuit against Proof's estate Monday.
