Title: So I spent the night in Jail for asking cops why my brother was in handcuffs...

Seriously, Fuck The Police.

Let me give you a play by play: I walk outside to 12+ cops, My brother in the middle of the street in handcuffs. I go up to the cops, ask them what is wrong. I am approached by cop #1, dude tells me to stand to the side, he said he would stand there with me. I stand there, he says he doesn't know what is going on neither and as soon as he does he will tell me. I go back inside, go look for my shoes, can't find them, go back to the same spot I was at previously. I ask again what is going on, he was in the house with me. Next thing I know I am getting handcuffed and arrested By cop #2 - he says i am interfering with a police investigation. I go really quietly, I plead with cop #1 to tell cop #2 what's up, he just shrugs his shoulders and cop #2 looks in full control. Cop #2 then goes on full asshole mode and starts talking shit to me "Remember, I am above you right now" - "You wanna talk? go get Larry H. Parker" - "Your The Bad Guy Today" - ALL I FUCKIN DID WAS ASK WHY THE FUCK THEY HAD MY BROTHER IN HANDCUFFS. He didnt do anything and was let go, but they took me in for that. When I was being booked I talked to the officer booking me and asked her if she felt this was right and she shrugged her shoulders and looked like she couldn't tell me anything in fear of what asshole cop #2 would say. Afterwards when I was in my cell, Cop #1 pays me a visit during the night after his shift, telling me I pissed two cops off, I tell him "This ain't right, you know it" and he gives me this blank look like "shit, what can I do?" - He ADMITS about me having to stand at that area he told me to and that I did and I listened to him. And He Admitted that I Did Not Resist Arrest (Officer #2 wrote I resisted arrest in the report, I check my ticket when I leave and it's crossed out and now says "DELAY") - hopefully cop #1 made that happen. Fuckin Justice for ya, When there are Murderers, Rapists, Drug Dealers And Thieves out there, They Arrest me overnight for Fucking Caring For Family. Fuck The Police, Bad seeds like this hothead Piece of shit Officer who fucking thinks he is the shit for doing this are the reason that cops get murdered by other dumbasses.

The Plus side to all of this is that all of this was recorded (According to Officer #2) - I want to hear all this in court, No way a judge or a jury would side with this injustice.

Fuck The Police.

Based on your account, it sounds like complete bullshit on their part.  What u shoulda done....Take a damn vid camera next time.  Tell them as soon as you walk out that they are being videoed.  Flip the script on them.  Anytime I talk to a cop I'm gonna tell them that they are being recorded.  I'm sick of these tiny dick bastards over stepping their bounds.

That would have been what I would have done, but shit happend so fast. I went today to go and get the police report given to me and they refused to give it to me. They told me I had to go thru the court and get it and they would not give it to me and that was that. (When I know for a fact I am supposed to have the right to have the police report when It is complete) - something's fishy. I know my rights and they are just fucking toying around. this is bullshit.

That usually works, because either they will fear of repercussions for them coming across as assholes, or they could get in trouble when the video comes out. Some of the people I know that become cops just seem like the kind of nerdy guy in high school, didn't really experience a lot or learn how to deal with others, and go on a power trip. If you would have videotaped this, you could have it on the news.

Update - Im going to trial Starting Tomorrow!

So yeah, we were supposed to start trial last week, But The Officer was on vacation (This date was set back in November and back then, the Judge said on Record that I have the right to have my trial date within 45 days of the date in November, I wanted to start the trial last week, and now I am missing out on a Job Interview and Potential Job because the Officer could not be bothered while he was on his leisure time, which I believe Is a violation of my 6th amendment right, My Lawyer objected to the delay, but the judge denied it. Im thinking of bringing that up so that it's on record tomorrow, so that in case this case goes against me (which it will not) - I mean if I wanted to go on vacation tomorrow, would I be allowed to?

Anyway that is that, I have videos Im going to use as evidence as well as testimony from my father and bro.

I met with the detective a day before I was due in court the first time last year, notice the Detective Never writes down anything, he does not care about my statement at all, the entire time he hears me out, but scolds me and tells me im wrong and I should have just let the officer slam my bro down and I should not have yelled. I never touched the officer that arrested me, i just yelled at him to stop fuckin up my brother because he did not do anything.

Talking to Detective Guerrero about Officer 1 and how he visited me in my cell. He tells me its not important because he will not testify in court and unless I have a witness that there is no reason I should even fight the case.

The reason I'm telling you guys my biz is because this is, I believe a injustice. I did nothing wrong, and My public defender seems the least interested in helping me out (dude is constantly sick and I have only met with him once outside of court about this matter, and I cannot get another public defender because they are all tied up on other cases in other departments) and the Judge already seems to favor the prosecution without looking at any facts, he basically called me guilty and has pushed this case back many times in favor of the prosecution. I can't afford a lawyer, and I really don't feel I should pay for a lawyer when I did nothing.

I want to fight it on my own without a lawyer, but I know very little about legal procedure and process, plus I don't think it would be a good look on the jury me fighting the case.

So yeah, Im facing 6 MONTHS IN JAIL for this. and If I don't win the case, I'm pretty much guaranteed going to jail at least a month (this judge has thrown people in jail for littering for a month when they lost their trial according to my public defender) - they wanted me to accept a lesser plea, but I was not about to pay or be on probation, especially for something i did not do.

so what do you guys think? seriously, it's tomorrow and my mind is racing on all possible outcomes tomorrow can bring.

Yeah man, public defenders don't give 1 shit about you, or winning your case...never go w/ a public defender.

why are you talking about a jury?  You won't have a jury.  It will just be the judge deciding on the outcome of the trial.  You public defender was just telling you that stuff about jail to try and scare you into admitting guilt because it makes his job much easier.  If you fight the case, that just means more work and time for him...thats why he says that stuff to you.

I don't know what crime you have been charged with, but I can 99% assure you that you won't be going to jail.  Have you been paying attention to the news at all?  They have been letting inmates out of prisons in CA.  CA is broke.  The jails and prisons are both very costly and very overcrowded.  So yeah, I wouldn't be too worried about going to jail.

But if you really believe in justice and want to win this case then my advice would be too spend all night preparing your case.  Research the law.  Create notes, and build a case.  At the very worst it will show the judge something and at least help you out a lil' bit.

My case is going to trial in front of a Jury. Tomorrow is Jury Selection day. I am charged with allegedly violating California Penal Code 148 (a) (1) –
Willfully Delaying, or otherwise Obstructing an officer or emergency
medical technician.

The judge also said that he would offer a lesser plea and that was it, and he was serious about locking people up who do not win their case.
I did not accept that plea last week.
I've seen him give drunk drivers probation and people committing petty theft a year (I've been going to this damn courtroom for almost a year while my case has been pushed back and back for a whole bunch of reasons, I know this guy's has mood swings basically, I guess it depends the mood he is in that day)

3)  Be honest with yourself.  You are going up against the DA.  You are going to lose this case if you represent yourself.  Don't be on Obama's Hopium...hope won't help you out.  The DA will embarrass you...especially if  you don't know anything about law and have no preparation.  Now I still don't think you will go to jail over this, but if you think you will...is it really worth it?  Now I'm all for fighting injustice too, but man, this isn't worth going to jail over.

My defense has been set since day one, I wrote out a whole 6 page report basically on what happened and different types of defenses I could use and used examples of previous similar cases and their outcomes.

The cop is going to testify, as well as the detective and the officer I was talking to at first. (I was talking to one cop, and the arresting officer heard me yelling at him and went on a power trip and arrested me) - to my knowledge they will all be there.

I honestly do not see what the D.A. has against me other than the officers testimony. there are no special witnesses, if anything I will have more witnesses and character witnesses that she does.
And its a 12 person Jury, this all has been pretty much embedded in my head since June, lol. again i've been in and out of that damn courtroom since then over this bs.

What the DA has against you is he knows the law inside and out.  That right there is in itself the reason why you will lose the case.  Its not about what is fair or what is justice, it is about knowing the laws and practicing law.  Like I said man, I think the DA is going to embarrass you.  I'm not trying to say that to diss you...there is a reason why lawyers charge so much money.  If regular people could just represent themselves, then lawyers would have to lower their fees...but that is not the case.

I've seen her work too, she's very laid back, but gets respect and attention because she is a very good talker (And Really Hot) - there is law and there is the truth, they can't hide the truth behind all their law jargon . I have video proof and evidence, if they have the video of the event then I am set, but they do not.
 I'm still on the fence about this, I'm hearing from a lot of people on things I should do/not do. I appreciate your feedback

There was a fight down the street with some kid reppin some gang trying to act hard and the neighborhood kids put him in his place. if you check the pic it was near the green truck, my brother was walking to his girls house down the street and was crossing the street when the cops all rolled up, It's a small city, so no matter what the entire force comes down when something goes on, no matter what it is, even if you were getting a speeding ticket, there are usually 3 sheriff cars rolling up.

they just assumed it was him because he was walking down the street and they couldn't find any other neighborhood kid to put it on. the dude and dude's girlfriend even yelled at the cops that it wasn't him (I would have them both as witnesses, but they moved out to Virginia or somewhere out east)

Look homie, you got fucked plain and simple. And honestly, there ain't shit you can do about it without the proper defense (of course, public pretenders ain't shit).

Present your case the best you possible can. That is all you can do. Like Grundy said, CA is broke. I know a dude that got 1 year for identity theft last month. He only spent 4 days in jail and now he's out on probation and did like 1 week community service.

You're facing half that sentence for a lesser charge. Even IF they convict you and give you 6 months, you're not gonna spend more than a couple of days in jail.

I know its easy for me to say because I'm not facing those charges, but believe me when I tell you that even if you get the worst case scenario, you will not face anywhere near that jail time.

Props for not giving in to the bullshit pleas. Keep your head up and do your best in court tomorrow. It's gonna all work itself out, even if you have a dickhead judge proceeding.

And fuck that bitch ass Gabriel Ingleseas lookin muthafucka in the videos. He's obviously a dick.

The bad thing about trials is when you lose they give you all that time.  A trial is always a bad look, I know cats thats serving 10 years bids cause they went to trial instead of taking a deal that would of probably gave them a few weeks/months or probation...

we didn't even get that far as to eliminate people based on preemptory challenges, just on cause (Which the judge did - We eliminated people who had kids who could not be there and the mayor of the city im in), and we hardly even got to that point and didn't even finish - the judge talks really really slow and asks every question in the book and has great long conversations with people about their personal life (it was really interesting, none the less and everyone was complaining about being there) - tomorrow we can eliminate on pre emptory challenges and narrow the jury down to 12. -

I was two classes away from completing all the requirements for a A.S. in Administration of Justice (Minus the General Education) (I was trying to be a cop or thinking of being a Lawyer back in the day) - I went on a ride along with the Ontario P.D. and that basically changed my life - I have never seen more obvious and careless abuse of power in my life - they were fucking with homeless ladies sleeping and kicking them off the curb for no reason and laughing while doing it thinking I would think it was amusing - I didn't want to associate myself with people like that - and also while I was there there was a cop who got shot and my buddy said he saw dude's wife and daughter going hysterical and that fucked him up too - he's still going to school and still wants to be a cop, but now im like Fuuck that. lol.

Update for the day - We are STILL picking the Jury and are scheduled to start tomorrow

Update - We finally selected a jury and started - The prosecutor gave her opening statement and My lawyer gave one as well.

We heard testimony from two officers - one officer who I was talking to and the other arresting officer - the arresting officer said he pulled out a tazer (NEVER HAPPENED) and they both said I was loud and waiving my arms around, They NEVER said I attacked or hit them, they just said I was loud, But the officer that arrested me said I was trying to get my brother out from the car (ALSO not true) and said he was arguing with me for about 5 minutes (it was no more than 30-45 seconds) - Both officers have conflicting stories on the Tazer part and the trying to get my brother out of the car part, The officer I was talking to and the arresting officer both said I was asking them why they slammed my brother down to the ground and why he was being arrested. they both deny slamming him down and exaggerated my cursing.
My bro and dad testified as well, My brother testified he was walking to his girls house and saw people in the street fighting, next thing you know police were behind him, grabbed him and slammed him to the ground violently. he said he couldn't hear me from inside the police car yelling and said he didn't know what he did wrong and wasn't told anything until about 5 minutes inside the back of the police car. My dad said I went inside to get him and told him that my brother was getting arrested for nothing, we came outside, I was yelling at the officers to tell me what was going on, and next thing you know they arrested me.
I then approached the witness stand and My lawyer began asking me question too - I basically reiterated what my dad said. I drew a diagram where I was at when they arrested me and where my brother was and where the officers were conducting their investigation.
I still need to be cross examined and that will happen today.

Today they expect the trial to end, I think they are going to recall one of the officers and call one more officer who was investigating the crime to the stand, I need to go an hour earlier so the judge goes over what he's going to ask of the Jury, and then we continue shortly after.

they are referring to their notes as a kinda "refresher" of their recollection - only the arresting officer wrote a report, the officer I talked to had notes and was referring to them - and yeah, my bro's testimony was pretty much as perfect as can be, he was never arrested or charged with anything, he did nothing. he was just walking to his girls house - the prosecutor only had 2 follow up questions to ask him.

cant imagine much is gonna come outta this anyways.  He was accused of delaying a police investigation on a suspect who wasnt even arrested lol  Unless he's got some serious priors...this wont be anything major at all.

yup, it costs $1k a day to try a trial.

So here's the final update on this:
I went in hung over as fuck, and I quit smoking but I needed a blunt before I went up in there, so I smoked, it calmed me down, and made me feel a little better, so I waited til they finally reached a verdict
I was found Guilty by the Jury, a jury where no one was younger than 30, 2 hispanic, 1 black and 9 white older people who were all over 50.
This was at about 10:30am
I was immediately taken back into holding and my sentencing hearing was set to be at 1:30pm
While I was going back there the bailiff said I might have had a chance if I had someone younger in my jury, or at least had more color in my jury. I asked him if he believed me and what I said he said yeah, but It wasn't up to him, I had to convince those 12 people.

So I waited, I called my girl up in there ($25 a call!!)
I just talked to her about anything and everything, I was next to some crackheads and then they moved me into my own cell later on. The whole time I was more in shock, and angry that I was found guilty, my girl was with my dad, and my mom and family wanted to come down, as well as some of my friends wanted to come down to see me and say something on my behalf, I said yeah, whatever, what can I do now?

so I waited, and waited, til about 3:45pm - then they called me in - First thing I see is my mom, ballin, that's when things really hit me and I was like "oh shit, im about to go in for a minute" - I felt like crying too, man I don't know what kinda stress and hardship I was putting on my mom and dad, what they were going to do without me working and just being at home. My best friends were also there with their ladies, my girl was there, she looked more angry than nervous, It was nerve wrecking as fuck.
The judge then called me up and my friend juan came up and spoke on behalf of everyone there. He told the judge I was a good guy, never been in trouble before, and that I had no bad intent, all I was doing was looking out for my family. He said awesome things, how I went to school, graduated, how I take care of my nephews, how I am the primary monetary provider at home, and so on. He had my back.

Then the judge spoke, he said he was very surprised at the verdict and that he really didn't believe I was at fault, but unfortunately it wasn't up to him, and that's how the law works in America. he talked about how I was against three white officers and they all had conflicting stories, and he brought up that I could have taken a lesser sentence almost a year ago but I was persistent and he saw that I was going at it because I believed I did nothing wrong, and I never missed a court date and I wasn't ever late. I was never disrespectful and he saw that it was in the heat in the moment and that due to the circumstances he could see how I could have done what I did and that if he was in those circumstances (seeing my bro getting slammed to the ground) he would have maybe done the same thing. he brought up that I had no priors, and basically everything my friend juan said - then the prosecutor said she wouldn't object to having my sentence to the original plea deal she offered last year (which is 10 days tree farm and $160 fine, plus 3 years summary probation) - he said he would agree to that and then sentenced me just that. I was then released right after at around 4pm. as soon as I finish the 10 days and pay the fine I can get off probation, so I'm going to try and get that done in the next month, and then have this expunged from my record.

So yeah, im still in kinda shocked at what happend and the outcome of the whole thing, but I can't really complain, im not in jail, im out, and I stood up for what I believed was right. I have the best friends and family ever though, they had my back and believed me and never doubted me.
But yeah, im out, we celebrated, and this is just another chapter in my life that has turned and now onto other stuff.

Yeah, but i don't know what good it would do. i already just got off with a fine and just 10 days of work. if i appeal it and lose again, i know for a fact ill be getting locked up.
