He'll get off the DUI charge.  From the story, he wasn't even driving, he was found on the side on the road and drinking in his car.  Who's to say he wasn't sober, car had problems and he pulled over and started drinking? 
You can get him for drinking in public, but I don't see how you can prove he was drinking and driving.
