the reason kobe's lawyers pointed out that she had sex a day before and a day after kobe's encounter is because the D.A claimed she had some vaginal tears after the encouter with kobe. This is their only evidence against kobe..no witnesses, nobody heard anything etc.. The defense has proof of 3 other guys semen from her dirty underwear also sperm was located on her inner thigh and neck area, sperm doesnt last more than a couple of days...so kobe's team is challenging the colorado rape shield law and they have been successfull so for.
