Eminem Drops His Case Against 'The Source'

Eminem (news - web sites) withdrew his federal copyright law infringement case against the Source magazine on Wednesday (March 16). The rapper's lawyer, Donald David, told New York's Daily News, "There is nothing left to win there broke." The judge already decided we have the copyright, and he awarded us $131,000 in sanctions. So the case has no purpose anymore."

publisher Dave Mays saw the dropping of the case as a victory. He said, "They want this withdrawal so they can avoid the public embarrassment of having Eminem on trial in New York."


Prior to Wednesday's withdrawal, Mays explained what would happen if Eminem was forced to take the stand. Mays said: "Basically, a lot of the truth behind this is gonna come out to people. In addition to the fact of his age that he lied about, he's lied about the story that he had a, quote, 'African American girlfriend' who broke up with him, which is why he wrote one of the songs, so he said. That's a lie."


Mays also explained what he thought was motivating the lawsuit. He said: "Their goal with the lawsuit, of course, has been to suppress a lot of the very bigoted and racist and offensive material that Eminem recorded when he was about 20 or 21 years-old. Not 16, which has been commonly reported."


The battle between Eminem and the Source began in November 2003 when the magazine held a press conference to play a tape of an early recording from Eminem that featured racially derogatory comments about African-American women. Eminem released two apologies, including a formal apology citing his then-young age and a recent breakup with an African-American woman as the reasons for the racially derogatory comments.


The beef moved into the courtroom in December 2003 when Eminem sued the Source for copyright infringement. Judge Lynch granted Eminem an injunction barring the Source from releasing the songs on a CD with its February 2004 issue. Later, the judge ruled that the Source could include 20 second snippets of the songs. Eminem subsequently filed an appeal challenging the decision.


Judge Lynch will decide on Monday (March 21) whether the complaint will be released with prejudice. If it is, Eminem will be unable to file the same lawsuit in the future.

Source was once the main information for hip hop news. Now Benzino has ruined it. Guarantee it has to do with the internet online websites, eminem's boycott, and other stupid shit benzino has done.
