Yeah.. And the story on that link says people would use the other bathroom he would... No. He would use the other bathroom. But shit... rightfully so. I don't give a fuck if I can't contract that shit from using the same toilet, I don't know what the fags doing in there. I wouldn't use the same bathroom either.

    Cingular Wireless claims to be a "Diversity Company" who embraces those who practice alternative life styles within the GLBT community. Members of management employed by Cingular Wireless have openly discriminated against an employee both for being gay, and for being HIV Positive.


    Miguel Dominguez is an employee at the East Los Angeles store of Cingular Wireless. Miguel has been discriminated against by both in store management and a member of the Human Resources Department. He has been chastised for his sexual orientation, and his HIV Positive status. I personally have not seen this kind of blatant discrimination since the early 1980's when ignorance and lack of education spawned a series of hate crimes, and a backlash toward the gay community never before seen on such a level.

    We are in the year 2006 in the second largest city in the United States of America. There is no room for the tolerance of this brand of ignorance. It is once again time for us to speak and let our voices be heard. This is not just a gay issue, this is a human issue.

Background:

    One Saturday afternoon in July 2006 Miguel Dominguez's domestic partner Marciano Martinez visited Miguel at work (Cingular Wireless Store S-901 in East Los Angeles) because he was going to join him for his lunch break. Upon Marciano's exiting the store a conversation was initiated by Miguel's Assistant Store Manager Rene Rodriguez questioning Miguel's relation to Marciano. Miguel informed Rene that Marciano is his Domestic Partner. Once this had been said Rene Rodriguez stated that it was improper of Miguel to disclose his sexual orientation at work, and that this behavior was strictly prohibited. Miguel Dominguez told Rene that had he not inquired there would have been no mention as to his relationship to Marciano. Rene once again responded by saying that this kind of talk is not acceptable in the work place.

    Cingular Wireless has a monthly news letter that is issued to employees by web-mail. The most recent issue included an article about how Cingular Wireless embraces it's GLBT employees and customers who live alternative lifestyles. Just as a point of question Miguel printed this article out and presented it to his Assistant Manager Rene Rodriguez. Rene dismissed the article and stuck firmly to his position against Miguel disclosing his sexual orientation.

    Within a few days Miguel was contacted by Human Resources Manager Jose Fialles to schedule a meeting in regard to a grievance complaint he had received. Someone within the store had filed a complaint about Miguel disclosing his sexual orientation. At this time neither his local manager or his Human Resources Manager informed him of his right to have a representative of the Union for Communications Workers of America present at this meeting. After the involvement of the Union.... it turns out that the complaint was filed by Sales Consultant Jorge Sanchez under the orders of Assistant Manager Rene Rodriguez. Furthermore Assistant Manager Rene Rodriguez and Human Resources Manager Jose Fialles are close acquaintances within the company.

    Miguel was contacted to have a second meeting with Human Resources Manager Jose Fialles, and Assistant Store Manager Rene Rodriguez. Others in attendance included Store Manager Jesse Avila, The CWA Union President, The Local Union Stewards, and the national president of Pride At Work. During this meeting statements written by Assistant Store Manager Rene Rodriguez and Sales Consultant Jorge Sanchez were submitted containing false information accusing Miguel Dominguez of smearing feces on the bathroom walls of the store, and putting the stores staff in danger of HIV infection. Their case in point was the result of a small cut that was on Miguel's head one day after he had shaved. This cut was covered with "liquid band aid, and in no way posed threat of infection to any of Miguel's co-workers unless they would have rubbed an open wound onto Miguel's head and there had been blood transfer. The Assistant Store Manager and fellow Sales Consultant stated that because they are uncomfortable working with a person who is HIV positive they have taken to using the woman's restroom instead of the men's restroom because that is the one Miguel uses.

    Needless to say the Management and fellow Sales Consultant continued to dig a grave of ignorance for themselves and as a result the Union had heard quite enough.

    Two weeks have elapsed since the meeting transpired and there has still been no resolve. Miguel has been forced to continue to work in the same store, with the staff members who have discriminated against him. As a result of this Miguel has encountered panic attacks, hyper ventilation, severe stress, and depression.

    On Wednesday October 4, 2006 as a result of the above mentioned conditions Miguel had to leave work and make the excursion on public transit to visit his doctor in West Los Angeles. The doctor decided it was necessary to increase the level of anti-depressant medications Miguel is currently taking. The doctor also gave Miguel a written note authorizing time off for the span of three days.

    Miguel contacted his store manager Jesse Avila and left a message to inform him of the doctors decision. Shortly after Miguel received a call from Jesse Avila informing him that although he has a doctors note he is in danger of termination. Clearly California State Law prohibits such action.

    On Saturday 10/07/06 Miguel Dominguez was asked to attend a meeting which would be geared toward resolving this issue of blatant discrimination. In attendance were Cingular Wireless Human Resources Representative Debra Napier, Rocio Blanco CWA UNION PRESIDENT, and Local Union Steward of CWA Anna Pathirana, and of course Miguel Dominguez himself.

    When everyone arrived at the meeting location all in attendance introduced themselves. Without any offer of apology for the situation Cingular Wireless Human Resources Representative Debra Napier pulled a note pad from her carry bag claiming it was to take doccumentation. Immediately she proceeded to grill Miguel Dominguez from questions on her note pad in a manner that would imply he is the criminal in this situation.

    This interrogation lasted for at least sixty minutes. While interrogating Miguel Dominguez Debra Napier repeatedly tried her best to catch him in a lie by contesting his answers and putting dates and times into question. Fortunately the union was there to confirm and back all of the dates and times for each of the violations in question.

    Debra Napier then proceeded to erase notes from her note pad stating that Miguel had not been clear. Miguel Dominguez told Debra Napier that everything he had said during this interrogating process was true and could be confirmed and that he had never once altered his responses during the interrogation. If anything was unclear it was due to Debra Napier's inability to articulate the situation.

    After the first hour Miguel became very uncomfortable and began to hyper ventilate and have an anxiety attack. When this began to happen Miguel informed Cingular Wireless Human Resources Representative Debra Napier that he would not answer any more of her questions until he was able to have a lawyer present and stood to leave the table. Debra Napier attempted to prevent Miguel Dominguez from exiting the meeting by telling, not asking, him to wait. Without allowing Debra any more space to place his physical health into further jeopardy Miguel informed Debra Napier that he was invited to the meeting to reach resolve, and instead she has spent her time trying her best to catch him in contradictions. Not once did she extend an appology, or give the slightest nod toward resolving the issue at hand.

    Local union steward Anna Pathirana exited the building with Miguel and explained to him that his actions were correct, and the union would be there to offer their support in any way possible should this issue commence to legal proceedings.

    Please send a proper email (no profanity or threats of bodily harm or property damage) to Kelly King, the Vice President of Cingular Wireless and Cingular Human Resources Representative Debra Napier to help us gain footing in this war for human rights. One sentence or a short statement.... it doesn't matter. Every little bit will help.

that sucks bad, you should wear buttons or slogans and get the other side out there too, i bet KTLA would air it or accuse them of unbiased journalism

I feel bad for one of my ex-co-workers. See, I used to work down the street from this store in East L.A. where this shit is going on at. I work in El Monte now, at a brand new store and that's where my asst. manager was transfered to, once it all started, too. But, a co-worker of mine from the other store is going to be transferred to that store as of the 1st of the Month. I would hate that shit!
what store in El Monte? ... i didnt even know we had a Cingular store in my hood
