He believed I was under the influence of alcohol.  It was around 350am, I was taking my pops to his business and midway there I see the sirens and I was like oh shit.  I was at the race track last night, $1 beer night.  I'd say I had about 5 beers there, and then 2 once my friends and I arrived home.  So I went to sleep at about 1215ish, there is no way that I was over the BAC limit. Not only is it not that many drinks, but I also had enough hours of sleep.  If anything, the dude just caught me sleepy.  He gave me the follow the pen, tilt your head back, etc tests plus the actual blow in the hole test.  He didn't give me the results, but he said "I'm going to let you go since you're not over the limit, but you are real close"  In my head I was thinking about saying, "ah no way, I doubt I'm even over .02" but I just decided to shut up and go to my car lol

When you know that you aren't doing anything illegal and the police have nothing on you, it gets tempting to talk more shit to them. It would have been funny to call "bullshit" on his comment, but it probably was a good idea for you to go back to the car. The only thing is your BAC level takes a while to go down, so even though you slept for a while and hadn't drank for a while and felt completely sober, it's possible that you were actually somewhat close.

lol nah.  I think it has more to do with the fact that there is a dance club on the street that I was driving on.  Maybe he was trying to bust people that were driving home drunk from the club.

Be thankful Javi , I caught a DUI in '07. In my DUI class we talked about certain laws, and technically under CA drinking&driving laws, if your BAC level is anything but .0%, the courts can charge you. So in reality, the cop could have charged you with a "Wet & Reckless". < Not as bad as a DUI, but just a lil knowledge.

Yep that can be plea, reduced charge, but if ur close to the.08 BAC level (but still under .08), you're likely to get a wet and reckless also

cops are retarded...they'll tell you you're close even if you're 0.0%. they do it just to try and catch you slippin, that's their main way of getting people. youll never get caught if you dont give yourself away. ive been pulled over TOSSED and was given a sobreity test so many times. alcohol, shrooms, thizz, weed.  just be confident and control the convo. if you're a pussy you can even get a dui when sober...PeACe
